The Board of Trustees of the Leland Stanford Junior University (“Stanford”)
provides RARE-Seq website features and services (“Service”),
including any accompanying information, data, software, materials, or manuals,
free of charge for non-commercial use only. Use of the Service by any commercial entity for any purpose, including research, is prohibited.
By using the Service, you agree to be bound by the terms of this Agreement. Please read it carefully. If you do not agree to the terms of this Agreement, then do not use the Service and promptly remove all copies of the software and data from your computer(s).
THE SERVICE IS OFFERED “AS IS”,
AND, TO THE EXTENT PERMITTED BY LAW, STANFORD MAKES NO REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. STANFORD SHALL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES WITH RESPECT TO ANY LOSS OR OTHER CLAIM BY YOU OR ANY THIRD PARTY ON ACCOUNT OF, OR ARISING FROM THE USE OF THE SERVICE. YOU HEREBY AGREE TO DEFEND AND INDEMNIFY STANFORD, ITS TRUSTEES, EMPLOYEES, OFFICERS, STUDENTS, AGENTS, FACULTY, REPRESENTATIVES, AND VOLUNTEERS (“STANFORD INDEMNITEES”)
FROM ANY LOSS OR CLAIM ASSERTED AGAINST STANFORD INDEMNITEES ARISING FROM YOUR USE OF THE SERVICE.
All rights not expressly granted to you in this Agreement are reserved and retained by Stanford or its licensors or content providers. This Agreement provides no license under any patent.
- You agree not to use the Service for commercial advantage, or in the course of for-profit activities. You agree not to use the Service on behalf of any organization that is not a non-profit organization. The use of the Service by, or on behalf of, any for-profit entity will terminate any and all licenses, express or implied, granted by Stanford under this Agreement. Commercial entities wishing to use this Service should contact Stanford University’s Office of Technology Licensing and reference docket S23-116.
- You agree not to use the Service for diagnosis, treatment, cure, prevention, or mitigation of disease or other conditions in man or other animals. You acknowledge that the Service and any information obtained therefrom is not intended to substitute for care by a licensed healthcare professional.
- You agree not to make intellectual property claims on the Service, and not to use intellectual property protection in ways that would prevent or block access to, or use of, any element of the Service or conclusions drawn directly from the Service.
- You agree not to distribute the Service or data, or to transfer the Service or data to any other person or organization, without Stanford’s prior written permission.
- You agree not to reverse engineer, reverse assemble, reverse compile, decompile, disassemble, or otherwise attempt to create the source code for the Service. You acknowledge that any programs created based on the Service will be considered a derivative of the Service and owned by Stanford.
- You agree not to make modifications to the Service. Title and copyright to the Service, any derivatives thereof, and any associated documentation will at all times remain with Stanford or licensee as per the above docket, and you agree to preserve same.
- You warrant that you will not remove or export any part of the Service from the United States except in full compliance with all United States and other applicable laws and regulations.
- You agree to make no attempt to identify or contact, either directly or indirectly, individual participants or their families. You agree not to use the data, either alone or in concert with any other information, to identify or contact individual participants from whom data and/or samples were collected. You also agree not to generate information (e.g. facial images or comparable representations) that could allow the identities of research participants to be readily ascertained.
- You agree that this Agreement and any dispute arising under it is governed by the laws of the State of California, United States of America, applicable to agreements negotiated, executed, and performed within California.
Subject to your compliance with the terms and conditions set forth in this Agreement, Stanford grants you a revocable, non-exclusive, non-transferable right to access and make use of the Service.
